SECTION 1 – WHAT DO WE DO WITH YOUR INFORMATION?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

With your permission, we may send you emails about our store, new products and other updates.

SECTION 2 – CONSENT

How do you get my consent?

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

How do I withdraw my consent?

SECTION 3 – DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 – Knownhost

Our store is hosted on Knownhost. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Knownhost’s data storage, databases and the general Knownhost application. They store your data on a secure server behind a firewall.

Payment:

If you choose a direct payment gateway to complete your purchase, then Stripe stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 – THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

SECTION 6 – SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

Terms and Conditions for AYA Subscriptions, Courses, Classes and Events


Overview

Ancient Yoga Academy (AYA) sells Tickets to various types of Events that are held and/or sponsored by the Company. By purchasing a Ticket or Subscription you agree to the Terms and Conditions written below. In some cases these conditions limit your rights so please read them carefully.

Minimum Subscriptions and Refunds

For Events:

Unless otherwise noted in the specific product description: Tickets for Events are non-refundable.

 No Cash Refunds. In the case that a refund is necessary, the refund amount will be issued in the form of “Credit” with the full value of the refund being available for other AYA services or store.

-Classes must be booked a week prior to event. Most of our events are not available for drop ins and wont ensure your participation if not booked in advanced.

Assumption of Risk, Waiver and Release

By signing up for and/or attending classes, events, activities, programs (collectively “Program(s)”) during any meditation, private session, class, whether as a participant or observant, and using the premises, facilities and equipment of AYA and/or the event venue owner, you acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns the following:

  1. The Programs may require physical exertion, which may be strenuous and may cause physical injury, and you are fully aware of the risks and hazards involved in participating in any Program and assume full responsibility for any and all injuries or damages, which are sustained or aggravated by you in relation to the Program;
  2. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated;
  3. You will progress at your own pace. If you experience any pain or discomfort, overexertion or fatigue, you will respect your body’s limitations and you will take a break before continuing with the Program;
  4. You have no medical or physical condition that would prevent you from full participation in the Programs and/or using any of the facilities or equipment that may be provided as part of a Program;
  5. You do not have any physical or mental condition that would put you in any physical or medical danger and have not been instructed by a physician to not participate in physical exercise;
  6. If you have any chronic disabilities or conditions, you are at risk to participate in any Programs and should not be participating in any Programs;
  7. You knowingly and voluntarily release, indemnify, hold harmless and covenant not to sue AYA (and their respective teachers facilitating any Program), their respective parent corporations and any affiliate entities, their respective officers, directors, employees, agents, or volunteers for any damages or bodily injury arising out of or in any way related to your participation in the Programs;
  8. You have been urged to avoid bringing valuables onto the Property and that neither AYA nor the venue shall be liable for the loss of, or damage to your personal property;
  9. You agree to abide by any etiquette guidelines provided by AYA and any teachers facilitating any Programs and understand that you may be removed from any of our Programs for acting in an inappropriate or unsafe manner.

You have read this Assumption of Risk, Waiver and Release and fully understand its terms, and further acknowledge that you are giving up substantial rights, including your right to sue AYA.

Notice of Filming and Photography

When you enter a AYA event, class or program, you enter an area where photography, audio, and video recording may occur.

By entering the event premises, you consent to interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by AYA and its affiliates and representatives.

Images, photos and/or videos may be used to promote similar AYA events in the future, highlight the event and exhibit the capabilities of AYA, and/or promote other AYA products.

You release AYA, its officers and employees, and each and all persons involved from any liability connected with the taking, recording, digitizing, or publication and use of interviews, photographs, computer images, video and/or or sound recordings.

By entering our event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged. You also waive any right to inspect or approve any photo, video, or audio recording taken by AYA or the person or entity designated to do so by AYA.

You have been fully informed of your consent, waiver of liability, and release before entering the event.
